Hubalabike Terms of Use (updated 01/26/2009)

Welcome on Hubalabike.com, an Internet portal which offers bike riders to share news and connect with other bike enthusiasts! This page defines the Terms of Use of this website, and the obligations of its users, which every user has to respect without any exception when using any of the services provided, or accessing or browsing any of its contents. These Terms of Use consequently come into force as soon as the Internet user accesses the homepage or any content displayed on hubalabike.com. The user is responsible of reading these Terms of use before using any service offered on hubalabike.com, and before he accesses any of its pages.

Please read these Terms of use carefully as they include important information about your obligations as a user of hubalabike.com. We also invite you to read our Privacy policy before using our website. Thank you for your attention!

What is Hubalabike?
Hubalabike is an online service provider, whose services allow registered users to create a profile, contact friends and other users on the website, share news with them, regroup in hubs (groups of users) and promote events. It provides all these services to allow users to create and be part of virtual bike riders communities.

I – Definitions
The following definitions explain the meaning of every term used in these Terms of use, including in the introduction paragraph, and to the end of this page.
1. “Hubalabike.com, Hubalabike, hubalabike, the website” all refer to the pages, contents and services proposed on hubalabike.com, from its homepage to any of its other pages.
2. “Internet user, user, users, you” refer to any person from the moment when they access Hubalabike or enter www.hubalabike.com or the url of any of its pages in their Internet browser. The user has to agree these Terms if se before accessing Hubalabike.
3. “Services, service” refer to the services provided by Hubalabike, allowing the Internet users to: sign up (and fill out personal data to create his personal profile), log in, enter personal data to complete his personal profile (including but not limited to: his name, a pseudo, his e-mail address, a password, pictures, messages), post news, vote or bury stories, create hubs, contact or be contacted by other Internet users, send or receive messages.
4. “Content, contents” can be used to refer to two types of contents: “Hubalabike’s own content” and “the users’ content”. See below for the definitions of both terms. They both include but are not limited to: texts, videos, pictures, schematics, drawings, comments, smileys, icons, urls, links, e-mail addresses, nicknames.
5. “Hubalabike’s own content” refers to the texts, pictures and videos which were published by Hubalabike, and which users can not modify. It includes but is not limited to: the About us and Contact us pages, the signing up, the login in, the submit a story forms, the Terms of use and the Privacy policy, the Pro section (Advertising).
6. “The users’ content, the submitted stories, the submitted content, the proposed content, the shared content” refer to the texts, pictures and videos which were shared by a user through Hubalabike’s provided services. It includes but is not limited to: the personal profiles of the users, the messages sent by users, the posted news, the votes, the stories submitted by the Submit a story link, the Upcoming news, the Hot news.
7. “Forbidden contents, content” refer to type of contents which are fully prohibited on Hubalabike. It includes but is not limited to: texts, videos, pictures which are unlawful in any way, defamatory, harmful, threatening, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful or racially or otherwise objectionable; or which violate any law or right of any third party (including Hubalabike); or which are pornographic or abusive.
8. “Submit, propose, share, upload, create, make available, send” refer to the action taken by the user of sharing any “Users’ content” with other users on Hubalabike, through our services (including but no limited to: texts, videos, pictures, comments, messages). The user who does so is the origin of the publishing.
9. “Transmit” refers to the action by the user of sending to other users or persons any received User’s content. The user who does so is not the origin of the publishing.
10. “Nickname, pseudo” both refer to the name the user uses to sign up and log in on Hubalabike.
11. “Story, new” refer to any User’s content, including but not limited to: texts, videos, pictures, comments, drawings, url links.
12. “Account” refers to the personal login each user obtains after signing up. It includes but is not limited to: nickname, password and any personal data filled out. The account is the user’s identity on Hubalabike, and is the origin of all the actions he could make on the website. Without an account, the user can not user Hubalabike’s services.
13. “Include, contain, including, for example” include the term “without limitation” immediately thereafter.

II – Acceptance of terms
By accessing Hubalabike.com or any of its pages, contents or services, you agree to become bound by these Terms of use, which you confirm having read carefully. If you do not agree with these Terms of use, globally or concerning any of its parts, you may not access the website or any of its pages, contents or services.

III – Eligibility
Hubalabike’s contents and services are only available for individuals who are at least 13 years old, and you may not sign up or access this website if you are under 13. Some contents and services of Hubalabike should not be accessed by children. If you are under 13, do not attempt to use our website, for your own protection. If you are a person over 13 years old, some restrictions could also apply. If you are not considered as a major person in the country where you live, you should not access to Hubalabike without the approbation of your parents or legal guardian. Please be sure you show them these Terms and have them approved by them before accessing Hubalabike. When clicking on the I have read and accepted the Terms of use link on Hubalabike, you have to be sure you are authorized to do so by one of your parents or legal guardian. By doing this, he then agrees to these Terms of use without any restriction, he authorizes you to use Hubalabike, and accepts to be fully responsible for your use of the website.If your parent or legal guardian does not agree with these Terms of use, you should not access any page of Hubalabike, nor use any of its service.

IV – Modification of the Terms of use
Hubalabike reserves the right to modify the present Terms of use, at its sole discretion, and at any time. If any change to the Terms of use by Hubalabike constitutes a material change, and could possibly change the users’ agreement on them, Hubalabike will notify the users by posting a note on the homepage of the website. Whether the changes constitute or not a “material change” will be determined by Hubalabike, at its sole discretion, using common sense and reasonable judgment in god faith. You will be responsible for reading them carefully, and agree or not with the changes. If you accesses the website after the changes to the Terms of use have been notified, it will constitute an acceptance of these changes. If you do not agree with the notified changes, you should not use Hubalabike any longer.

V – Description of services
Subject to full compliance with the present Terms of use, Hubalabike may offer to provide services to its users (as defined in the I-Definitions paragraph). Hubalabike offers a feature whereby users can share content with other users. Our services include, but are not limited to any service Hubalabike provides to its users: signing up, creating and managing his personal profile, uploading pictures or videos, sending and receiving messages, creating hubs, inviting other users on these hubs, sharing stories, voting for or burying stories.

Hubalabike may change, suspend or discontinue any of the services it provides, including any content, for any reason at its sole discretion and at any time, including the availability of any service or content, without any notice or liability. Hubalabike may also limit the access to certain services or contents, for any reason at its sole discretion and at any time, without any notice or liability.
You acknowledge and agree that your use of Hubalabike’s services and all contents you share on our website through these services fully comply with these Terms of use. If your use of Hubalabike’s services does not respect the rules set in this page, you may not use Hubalabike.

VI – Registration obligations
Considering your use of Hubalabike, you are required to sign up by filling out the dedicated form. For every field or question of this form (including but not limited to: name, pseudo, password, e-mail, security question, security check, birthday), you must provide Hubalabike with true, accurate, complete and updated information. Moreover, you may not: select or use the name of someone else with the intent to impersonate or to penalize someone, use a name for which you are not certain to have the complete and appropriate authorization to use, or to use a name which is offensive, vulgar or obscene. Hubalabike reserves the right to refuse any registration or suspend any account, at its sole discretion and at any time, without any notice or liability. When creating or updating his profile, you fully understand that your information will become readable by other users. You agree not to spread confidential data, whether regarding yourself or any other person. You will be solely responsible for any use of information you could have spread, whether intentional or not.

You must also update your personal information if modified, as soon as possible. Failure to provide Hubalabike with truest information constitutes a breach of the Terms of use, which may result in the immediate and definitive termination of your account on Hubalabike. You are required to choose a secured password and identification, and to make everything possible to maintain it secured. If you happen to know that your password or identification codes may have been known by someone else, stolen, copied or spread, you are responsible for changing it as soon as possible. Considering that, you accept to be solely responsible for all uses of your account, and for action that takes place through or using your account.

VII – User conduct
The only commercial contents allowed on Hubalabike are the banners displayed on its pages, and dully approved by Hubalabike within the frame of its advertising policy, at its sole discretion. You do not have the right to use Hubalabike as a commercial medium, so you agree and warrant not to give price information, on any of the pages of the website. You also warrant that the contents you propose (Users’ content, using any of Hubalabike’s services) will not violate, offense or infringe upon the rights of any third party, including Hubalabike (including but not limited to: copyright, trademark, privacy, publicity or any other personal or proprietary rights), and will not be defamatory, offensive, vulgar, obscene or unlawful.

In addition, but no limited to the following, you agree and warrant not to:
Regarding relations with other users, persons and entities
1. Abuse, harass, threaten, impersonate or intimidate other users, or any other person.
2. Impersonate or attempt to impersonate any other user or person or entity.
3. Register on behalf of another user or person other than yourself.
4. Register on behalf of any group or entity.
5. Attempt to use another user’s account.
6. Create, submit, transmit, or cause to be created, submitted or transmitted any private information regarding any third party (including but not limited to: users, persons, entities, Hubalabike), including but not limited to: addresses, phone numbers, e-mail addresses, social security numbers, credit card numbers.
7. Upload, submit, transmit or cause to be uploaded, submitted or transmitted any content that could restrict or inhibit any other person, user or entity from using Hubalabike, or that may cause to Hubalabike or any user or person any harm or liability of any type.

Regarding registration and the user’s personal data
8. Provide Hubalabike with any false information at any time, including but not limited to: give an inexact age.
9. Create a false identity on Hubalabike
10. Give Hubalabike any false or inexact information.
11. Register for more than one account.

Regarding the laws, or any illegal or unlawful use of Hubalabike
12. Use Hubalabike for any illegal, unlawful or unauthorized purpose. You are solely responsible for being aware of and respecting the law regarding your conduct while using Hubalabike.
13. Violate any law in your jurisdiction (including but not limited to: copyright, trademark, privacy, publicity or any other personal or proprietary rights). You are solely responsible for knowing and respecting the law.
14. Upload, submit, transmit or cause to be uploaded, submitted or transmitted any content that encourages, provides instructions for or constitutes a criminal offense, violates any local, state, national or international law, or that violates any third party’s rights.
15. Post, upload, submit, share, propose, store, or cause to be posted, uploaded, submitted, shared, proposed or stored any content (including but not limited to: texts, videos, pictures) which is unlawful, defamatory, harmful, threatening, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful or racially or otherwise objectionable, or which violates any law or right of any third party, or which is pornographic or abusive.
16. Post, submit or transmit, or cause to be posted, submitted or transmitted any Forbidden content (see Definitions).
17. Upload, submit or transmit any video other than fully copyrights-free, or of a personal nature: whether of you or your friends and family, or taken by you or your friends or family, or a piece of original art or animation created by you or your friends or family.

Regarding Hubalabike’s measures and proper functioning
18. Bypass any measure Hubalabike could take, for any reason and about any of its services or contents.
19. Interfere or attempt to interfere with the proper working of Hubalabike or with any of its services or contents.
20. Alter or attempt to alter, damage, disable, overburden or impair Hubalabike or its services or contents, including but not limited to: create separate accounts, give or receive any remuneration for votes or for submitting stories.
21. Register for more than one account.
22. Upload, submit, transmit or cause to be uploaded, submitted or transmitted any content that contains files, computed programs, viruses designed to destroy, interrupt or limit the functionality of any equipment or service (including but not limited to: computers, softwares, hardwares, telecommunication equipments).

Regarding automatic scripts
23. Apart accessing RSS feeds, use any automatic script, including but no limited to: any robot, spider, scraper or other automated means to access Hubalabike for any purpose.
24. Use automatic scripts to collect information or interact with Hubalabike, its services, contents and users in any way.

Regarding commercial use of Hubalabike and advertising
25. Submit, transmit, or cause to be submitted or transmitted any new with a commercial purpose (including affiliate programs, multi-level marketing schemes, websites repurposing existing stories or duplicating existing content).
26. Post and transmit, or cause to be posted and transmitted any solicitation to obtain other users’ personal data (password, identification codes, account, e-mail or any private information)
27. Solicit personal information from any user or person under 18 years old, or solicit any personal information of any user for commercial or unlawful purposes.
28. Sell or transfer any profile or personal data.
29. Use Hubalabike to collect e-mails or personal data for the purpose of sending unwanted solicitations, or for any other purpose.
30. Create, submit, transmit or cause to be created, submitted or transmitted any unwanted advertising, solicitation, promotional materials or e-mail (including but not limited to: spam, junk mail, chain letter) to other users or persons, or not to use a Hubalabike account to do so.
31. Advertise or solicit any user to buy or sell products or services, including using Hubalabike’s services or content to do so, and including using Hubalabike’s services and contents to solicit any person, even if not user of the website.

Hubalabike reserves the right to remove any account, for any reason (including but no limited to claims or allegations from third parties or authorities) at its sole discretion, and at any time, without notice or liability, or for no reason at all.

VIII – User’s content
You are solely responsible for any content you post, submit or transmit, including but not limited to: photos, names, images, messages, notes, music, texts, comments, video, advertisements, e-mails, pseudo. When creating, posting, transmitting or causing to be created, posted or transmitted a content, you are represent and warrant that you own all rights in that content (including but not limited to: texts, photos, comments, videos) whether the content has been created by yourself, or if all rights on the content have been transmitted to you, or if the content is subject to the Creative Commons Public Domain License (http://creativecommons.org/licenses/publicdomain). If you did not create the content you want to submit, or if you do not have the permission to submit it, you may not submit this content to Hubalabike. For clarity, the present paragraph does not apply to the content on any external website to which Hublabike links, as the website links to other websites, but does not control their own content.
You understand and agree that Hubalabike may, but has no obligation to, review the website and delete or remove any account, content or service, at its sole discretion, at any time and without notice or liability, including but not limited to: content that violates the resent Tems of use in any way, or that corresponds to a Forbidden content (see Definitions). You are solely responsible at your sole cost and expense for publishing Forbidden contents, which were or not removed by Hubalabike.

When you post a story on Hubalabike, you know and agree that Hubalabike makes copies of your content, and that Hubalabike makes as many copies as necessary in order to facilitate the postage and the storage of the User’s content on the website.

By posting, transmitting or causing to be posted or transmitted any content, you agree that the content will be subject to the Creative Commons Public Domain License (http://creativecommons.org/licenses/publicdomain). If you do not want your content to be subject to this License, you may not post or transmit it, or cause it to be posted or transmitted.

IX – Copyright complaints
As an online service provider which stores information on systems or networks at direction of users, Hubalabike is subject to and fully applies the Digital Millennium Copyright Act (“DMCA”). Hubalabike respects the intellectual property of others, and we prohibit our users from posting, transmitting or causing to be posted or transmitted any content that violates a third party’s intellectual property. That is why Hubalabike will respond expeditiously to claims of copyright and any intellectual property infringement, when received as described below (see How to notify Hubalabike of a Copyright infringement below). When receiving such a Copyright infringement notification, Hubalabike will quickly process it and take appropriate actions under the Digital Millennium Copyright Act (“DMCA”) and other applicable property laws. In response to a Copyright infringement notification, Hubalabike will remove or disable access to the notified content as soon as possible. Hubalabike will also delete the account of repeated infringers (see Repeat infringers policy below).

If you believe that any content on hubalabike.com infringes upon any copyright which you own or control, you may notify Hubalabike of a Copyright infringement (see How to notify Hubalabike of a Copyright infringement below). As soon as Hubalabike receives your notification, we will make everything possible to delete or disable access to the notified contents or services. Once the notified content is deleted or non-accessible in response to a Copyright infringement notification, Hubalabike will make reasonable attempts to contact the owner or administrator of the affected content. If you feel that the deleted contents did not constitute an infringement, you may provide Hubalabike with a counter notification (see How to provide Hubalabike with a Counter notification? below).

How to notify Hubalabike of a Copyright infringement?
If you believe that any content on Hubalabike infringes upon a copyright you own or control, you may notify us of a Copyright infringement, so we can delete or disable access to the notified contents. To do so, please proceed like described:
- send an e-mail to report-abuse@hubalabike.com
- as a subject, write Copyright infringement notification
- in the e-mail, precise the following: your name, an e-mail address at which you can be contacted, the page where the notified content can be found, the copy of the exact content that infringes your copyright, and the mention “I officially demand that Hubalabike deletes or disables access to the previously quoted content”.

Please note that you may be liable for damages (including but not limited to costs and fees) if you misrepresent that a content is infringing your copyrights.

How to provide Hubalabike with a Counter notification?
If Hubalabike informs you that we have deleted or disable access to a content that was infringing a copyright you own or control, and if you feel that this content was not infringing any of your copyrights, you may send Hubalabike a counter notification. To do so, please proceed like below:
- send an e-mail to report-abuse@hubalabike.com
- as a subject, write Copyright infringement – Counter notification
- in the e-mail, precise the following: your name, an e-mail address at which you can be contacted, the copy of the message you received from Hubalabike (including the deleted content that is not infringing your copyrights), and the mention “I officially agree that the previous quoted content is posted on Hubalabike”.

Please note that you may be liable for damages (including but not limited to costs and fees) if you misrepresent that a content is infringing your copyrights.

Repeat infringers policy
According to the Digital Millennium Copyright Act (DMCA) and other applicable law, Hubalabike will delete the accounts of users who repeat Copyrights infringes, at any time, without notice and at Hubalabike’s sole discretion. Hubalabike may also, but has no obligation to, delete any account of any user who infringes copyrights or intellectual property rights of any third party, whether or not there is a repeat infringement.

X – Third party content and links
As Hubalabike provides its users with services which allow them to share news with other users, the User’s content may contain links to other websites as well as texts, pictures, graphics, designs, music, videos, information, applications, sounds, softwares or any type of contents for which any third party owns or control the copyrights. You acknowledge that Hubalabike is not responsible for the availability of any third party’s website, content or service our website links to. As Hubalabike only provides news-sharing services to its users, the User’s content is not investigated or checked by us, and can be shared without implying an approval or an endorsement by us. Hubalabike is consequently not responsible or liable for any Forbidden content in the User’s content. You acknowledge that Hubalabike is not responsible or label for the consequences your access to any third party’s website, content or service, even if invited to do so by our content, is at your own risk. If you decide to leave Hubalabike and access a third party website a content links to, you do so at our own risk and you should know that our Terms of use no longer govern. You should read carefully and accept the Terms of use of any new website to which you navigate (even if a link on Hubalabike invites you to do so).

Reference to any third party’s products, services, processes or any information (including but not limited to trademarks, trade names, manufacturer, supplier) does not constitute or imply any endorsement, sponsorship or recommendation or affiliation by Hubalabike with any third party.

XI – Hubalabike privacy policy
In addition to these Terms if use, Hubalabike also invites you to read and agree to our current Privacy policy, which is incorporated by this reference. The Privacy policy explains Hubalabike’s obligations and practices towards the personal information users may provide us with. It can be read there: www.hubalabike.com/privacy-policy.

XII – User disputes
You are solely responsible for your interactions with other users of Hubalabike. Hubalabike reserves the right, but has no obligation to, monitor disputes between users of the website. Hubalabike also reserves the right to delete or limit the account of any user who would post Forbidden content, including but not limited to, in the case of disputes: offensive, outrageous, defamatory, aggressive, violent, harmful, threatening messages or content of any type.

XIII – Indemnity
You will indemnify and hold harmless Hubalabike or any third party, and Hubalabike’s or any third party’s parents, customers, vendors, employees, subsidiaries and affiliates from any liability, damage or cost resulting from an claim or demand due to you or your access to Hubalabike, directly or indirectly, including but not limited to: your use of the services, violation of the Terms of use, the infringement by you, or any third party using your account, of any intellectual property or right of any user, person or entity.

XIV – Disclaimers
You acknowledge that Hubalabike is an online service provider, and has no control and is no responsible or liable in any manner for any User’s content, or any third party content or application shared or caused to be shared by a user or in connection with our services. These Terms of use provide users with rules for their conduct and their use of our services, but we can not and can not be held responsible for what users post, share, transmit or cause to be posted, shared or transmitted on our website or by using our services. Hubalabike is not responsible for any Forbidden content users could share, transmit or cause to be shared or transmitted, whether it is obscene, offensive, inappropriate, unlawful or otherwise objectionable, and whether it is text, videos, pictures, graphics, comments, applications, etc. Hubalabike is not responsible for its users’ conduct, whether online or offline, and whether on Hubalabike or on any other third party website.

You acknowledge that Hubalabike has no control and no duty to take action regarding who are the users who access the website, the effects our content and services may have on you or on anyone else, the way you interpret the content and services, the actions you may take after having read our contents or used our services. Hubalabike’s content may lead you to third parties’ websites. You acknowledge that Hubalabike can not be responsible neither for you navigating to them, nor for your use of their contents and services, nor for their contents and services. These Terms of use do not apply to third parties’ websites, so they may contain contents or services that some people could find offensive, unlawful, aggressive or objectionable in any way. Hubalabike makes no representation concerning any content or service accessed through our contents or services. Hubalabike will not be liable or responsible for the accuracy, copyright compliance, legality or decency of: the users’ content, and of any content or service of any third party’s website accessed through Hubalabike or its contents or services.

Maintenance operations or other reasons could make Hubalabike temporarily unavailable, at any time and without notification, at Hubalabike’s sole discretion. Hubalabike assmes no responsibility for any consequence these interruptions could have, including but not limited to: errors, interruptions, delays, failures, alterations, thefts of users’ communications. Hubalabike is not responsible or liable for any problem regarding the telephone network or Internet services, computer systems, softwares, e-mail services and softwares, computer devices, and any content or service provided by any other third party. Hubalabike is not responsible for the consequences of any malfunction or error of any third party’s services or contents, including but not limited to: injury or damage to the user’s or any person’s computer, damage to any hardware or software. Hubalabike is not responsible for any loss, injury, death or damage to any user or person resulting from anyone’s use of Hubalabike, or its services or contents, or use of any Users’ content, or use of any third party’s content or services or application, or resulting from any interactions between users or any other persons, whether online or offline.

HUBALABIKE, HUBALABIKE’S CONTENTS AND SERVICES ARE PROVIDED “AS-IS”, AND HUBALABIKE DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES OF ANY TYPE, EITHER IMPLIED OR EXPRESS, INCLUDING, BUT NOT LIMITED TO: WARRANTIES OF MERCHANTABILITY, WARRANTIES OF TITLE, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. HUBALABIKE DOES NOT PROMISE ANY SPECIFIC RESULT FROM THE USE OF OUR WEBSITE, CONTENTS OR SERVICES. HUBALABIKE DOES NOT REPRESENT OR WARRANT THAT ANY OF OUR CONTENT OR SERVICES ARE COMPLETE, RELIABLE, CURRENT, ERROR-FREE OR ACCURATE, OR THAT THE USE OF OUR SERVICES OR CONTENTS ARE FREE OF VIRUSES OR FREE OF ANY OTHER HARMFUL CONTENT. YOU MAY EXERCISE CAUTION IN THE USE OF HUBALABIKE, AND YOU ARE SOLELY RESPONSIBLE OF THE CONSEQUENCES YOUR USE COULD HAVE ON YOU OR ON ANY OTHER USER OR PERSON, AND SOLELY RESPONSIBLE FOR USING INDUSTRY-RECOGNIZED SOFTWARES TO PROTECT AGAINST VIRUSES. YOU UNDERSTAND AND AGREE THAT YOUR USE OF HUBALABIKE, INCLUDING BUT NOT LIMITED TO: UPLOADING, DOWNLOADING, SHARING OR TRANSMITTING OF CONTENT, IS AT YOUR SOLE DISCRETION AND AT YOUR OWN RISKS, AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR YOUR USE OF HUBALABIKE AND OF ANY DAMAGE, LOSS OR HARM THAT MAY RESULT.

XV – Limitation of liability
IN NO EVENT WILL HUBALABIKE, HUBALABIKE’S EMPLOYEES, SUPPLIERS OR AGENTS BE LIABLE TO YOU OR TO ANY THIRD PERSON UNDER CONTRACT, NEGLIGENCE, STRICT LIABILITY, TORT OR ANY OTHER LEGAL THEORY FOR: ANY LOST PROFITS OR LOST DATAS, OR ANY INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGE OF ANY KIND ARISING FROM YOUR USE OF HUBALABIKE, EVEN IF HUBALABIKE HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. HUBALABIKE’S LIABILITY TO YOU FOR ANY CAUSE WILL AT ALL TIMES BE LIMITED TO THE AMOUNT YOU HAVE PAID TO HUBALABIKE. YOU AGREE THAT IF YOU AVE NOT PAID ANYTHING TO HUBALABIKE, YOU SHALL BE LIMITED TO INJUCTIVE RELIEF ONLY, SHALL NOT BE INTITLED TO DAMAGES OF ANY KIND, UNLESS OTHERWISE PERMITTED BY LAW.

XVI – Termination
Hubalabike reserves the right to delete your account, delete any of the content you could have shared or limit your access to our contents and services, without any notice or liability, at our sole discretion, if you breach the Terms of use in any way, or for any other reason, or for no reason at all. Once your account has been deleted, you rights to access Hubalabike’s contents and services immediately cease. If you wish to terminate your account on Hubalabike, you may inform us by writing to deleteme@hubalabike.com. In this e-mail, please precise the following: your name, your pseudo on Hubalabike and the e-mail address you have used to sign up on Hubalabike. The provisions of these Terms of use, which should survive termination by their nature, shall survive termination.

XVII – Other and arbitration
No partnership, joint venture, agency or employment is created by these Terms of use. Hubalabike shall not be liable for any failure to perform its contents and services resulting from any cause beyond Hubalabike reasonable control. If any provision of the Terms of use is found to be invalid, that provision should be limited or eliminated with the minimum consequences on the other provisions, so that the Terms of use remain in full force and effect. The Terms of use are not assignable or transferable by you. Hubalabike shall transfer or delegate the Terms of use without notification, at any time and at its sole discretion.
